IN exercise of the powers conferred by section 23 of the Lembaga Kemajuan Ikan Malaysia Act 1971 [Act 49], the Lembaga, with the approval of the Minister, makes the following rules:

 

1 Citation, application and commencement

(1) These Rules may be cited as the Lembaga Kemajuan Ikan Malaysia (Fisheries Complexes and Harbours) Rules 1986 and shall apply to West Malaysia and Sarawak.

     (2) Except as provided in sub-rule (3), these Rules shall be deemed to have come into force on the 1st February 1986.

     (3) Rules 4, 7 and 8 shall come into force on the 1st April 1986.

 
 

2 Interpretation

In these Rules, unless the context otherwise requires­

"complex" means the fisheries complex of the Lembaga as specified in Part I of the First Schedule and includes any jetty, landing place and other areas adjoining it on which may be erected a wholesale fish market or an auction hall;

            "deal" means purchase, sell or consign and includes offer or expose for sale or keep for sale and   auction;

             "harbour" means the fisheries harbour as specified in Part II of the First Schedule and includes any wharf, pier, dock,jetty, landing place and other areas adjoining it on which may be erected a wholesale fish market, repair yard or fuel and ice supply installation.
 

3 Restriction on dealing of fish

No person shall deal in any fish within any complex or harbour unless he is the holder of a valid licence issued under the Fish Marketing Regulations 1973 [PU (A) 381/73].

 

4 Restriction on entry into a complex or harbour

No person shall enter any complex or harbour for the purpose of loading, unloading, keeping, collecting, selling, purchasing or offering to sell or purchase, fish unless he is the holder of a permit issued under rule 5.

 

5 Application for permit

(1) Every application for a permit to enter any complex or harbour shall be made in writing to the Director General and shall contain the following particulars:

            (a) the name, national registration identity card number and address of the applicant;

(b) the business name and address of the applicant, if any;

(c) the purpose for which the permit is required; and

(d) such other information as the Director General may require.

(2) The permit issued under this rule shall be in such form as may be prescribed, and subject to such terms and conditions as may be imposed, by the Director General and shall be valid for the period stated therein.

(3) The fee payable in respect of the permit issued under this rule shall be as prescribed in the Second Schedule.

(4) The Director General in issuing such permit shall allow only such number of persons who shall be engaged in the loading, unloading, keeping, collecting, selling or purchasing of fish to enter such complex or harbour, and shall issue to each of such person, including the permit holder, a badge to be worn on entering the complex or harbour.

 

6 Charges for using a complex or harbour facilities

There is imposed in respect of the use of any facilities of any complex or harbour the charges as set out in the Third Schedule.

 

7 Erection of structure, etc prohibited

No person shall make any alteration to any part of a complex or harbour, or erect any structure or place any obstruction whatsoever within or immediately outside any complex or harbour without prior consent of the Director General.

 

8 Prohibition on loitering, fishing, etc

No person shall­

(a) loiter, swim or fish within a complex or harbour;

 

(b) repair or construct any fishing net or gear on the jetty or at any other place in a complex or harbour without the written permission of the Director General; or

(c) supply fuel, ice, provisions or services or conduct any business in a complex or harbour without the written permission of the Director General.

9 Compliance with the directive of Director General

All persons using a complex or harbour shall observe all directives as the Director General may give from time to time.

 

10 Service charges on imported or unauctioned fish

The Lembaga may impose the service charges as prescribed in the Fourth Schedule on all fish which are­

(a) imported from another country and brought into any complex or harbour; or

(b) removed from any complex or harbour otherwise than by transaction in an open auction system prescribed by the Lembaga.

11 Exemption

The Lembaga may exempt any person from all or any of the provisions of these Rules.

2 lorry, bus or truck (exceeding unladen weight 1500 kg)... $30.00 per month
3 motorcycle....  $5.00 per month

PART III

Fee for temporary permit of vehicle, other than those issued with a season permit under Part II, for the use of space at the complex or harbour exceeding one night:

1 motor-car, van, station-wagon, motorcycle with side-carriage or pick-up (not exceeding unladen weight 1500 kg)...... $5.00 per night
